LegalSETL Terms of Use
The rules for using SETL, written in plain English. Please read them before you buy.
These terms explain the rules for using SETL. Please read them before you buy. By downloading or using SETL, you agree to them. If you do not agree, please do not use SETL.
1. Who we are
SETL is provided by Jacob Redshaw, trading as SETL ("SETL", "we", "us"). You can contact us at jacob@setlsleep.com.
2. These terms and Apple's licence
You get SETL from the Apple App Store. Your licence to use SETL is Apple's Licensed Application End User License Agreement, which you can read at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. These terms add to Apple's agreement. If the two conflict, Apple's agreement applies.
These terms are between you and us, not Apple. We, not Apple, are responsible for SETL and its content. Apple has no duty to provide support for SETL. Apple and its subsidiaries may enforce these terms against you.
Our Privacy Policy explains how we handle your data.
3. Who can use SETL
You must be 18 or over to use SETL. SETL is for your own personal use on an iPhone you own or control.
4. What SETL does
SETL helps you set a bedtime and keep to it. It uses Apple's Screen Time tools to put the apps you choose to sleep at the times you set. It also sends reminders and shows how you used your phone.
5. Buying SETL
SETL needs an active trial, an active subscription or a lifetime purchase to use. All of them unlock the same Pro features.
Plans. We offer weekly, monthly and yearly subscriptions, and a lifetime purchase. The price, billing period and any trial are shown in the app before you confirm. Prices may vary by country and include any taxes Apple applies.
Trials. Some plans start with a free trial. Where a trial is offered, its length is shown in the app before you confirm. You are not charged during the trial. Apple decides who is eligible. Usually each Apple ID can use one trial. When the trial ends, it turns into the paid plan and you are charged, unless you cancel at least 24 hours before the trial ends. If you buy a subscription during a trial, any unused part of the trial ends.
Payment. Payment is charged to your Apple ID account when you confirm your purchase, or when your trial ends.
Renewal. Subscriptions renew automatically for the same period and price unless you cancel at least 24 hours before the end of the current period. Apple charges your Apple ID within the 24 hours before the period ends.
Lifetime purchase. Lifetime is a one time payment. It never renews and you are not charged again. It unlocks the same Pro features as a subscription for as long as we offer SETL on the App Store, and you can restore it on any iPhone signed in with the same Apple ID. If you have a subscription and buy lifetime, cancel the subscription so you are not charged for both.
Price changes. If the price of your subscription changes, Apple will tell you in advance. Where the law or Apple's rules require it, you will be asked to agree to the new price before it applies. A price change never affects a lifetime purchase you have already made.
How to cancel. Open Settings on your iPhone, tap your name, then tap Subscriptions. You can also tap Manage subscription in SETL's Settings. When you cancel, you keep access until the end of the period you have paid for. Deleting SETL does not cancel your subscription.
6. Refunds
Apple handles all payments and refunds for SETL, including lifetime purchases. We cannot issue refunds ourselves. To ask for a refund, go to reportaproblem.apple.com. Apple decides refund requests under its own terms. Nothing in these terms affects your legal rights as a consumer.
7. Using SETL properly
You agree not to:
- copy, change, sell or share SETL, or try to get its source code, except where the law allows
- get around the paywall, or use SETL without a valid trial, subscription or lifetime purchase
- use SETL to control or monitor another person's device without their permission
- use SETL in a way that breaks the law or harms SETL, other users or anyone else
We may suspend or stop your access to SETL if you break these terms in a serious way. This does not affect your rights with Apple for a purchase you have paid for.
8. SETL is not medical advice
SETL is a tool to help you build better phone habits at night. It is not a medical device. It does not diagnose, treat, cure or prevent any condition. SETL is not a sleep treatment. It does not treat insomnia, ADHD, anxiety, depression or any other condition.
SETL does not measure your sleep. Figures such as your Sleep Reserve are estimates based on your settings and your phone use. They are not health data.
If you are worried about your sleep, your mental health or any other health matter, please speak to your GP or another qualified professional. In the UK you can also call NHS 111. In an emergency, call 999.
9. Screen Time and Apple's systems
SETL depends on Apple's Screen Time permission and on tools that Apple controls. This means:
- SETL can only block apps while you allow its Screen Time access. You can turn this off in your iPhone's Settings at any time, and blocking will stop.
- Blocks, reminders and reports can fail or be delayed because of changes to iOS, Apple's limits on Screen Time apps, software faults, Low Power Mode, restarts, storage issues or other things outside our control.
- Some apps and parts of iOS cannot be blocked by any app.
- Apple may change or remove the tools SETL relies on. If that happens, some features may stop working.
We work hard to keep SETL reliable, but we cannot promise that every block or reminder will always work. Please do not rely on SETL where a failure could cause harm.
10. Changes to SETL
We may update SETL to add, change or remove features, fix problems or meet Apple's rules. If a change makes SETL much worse for you during a period you have paid for, or after a lifetime purchase, you may be entitled to a refund under consumer law. Please contact Apple or us.
11. Our responsibility to you
We provide SETL with reasonable care and skill.
What we do not exclude. Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded under the law of England and Wales. Your legal rights as a consumer, including under the Consumer Rights Act 2015, are not affected.
What we are not responsible for. As far as the law allows, we are not responsible for:
- losses that were not foreseeable when you started using SETL
- business losses, such as lost profit or lost business opportunities, because SETL is for personal use
- problems caused by Apple, iOS, your device, your internet connection or other things outside our reasonable control
- losses caused by you not following these terms
Limit. As far as the law allows, our total liability to you for all claims about SETL is limited to the amount you paid for SETL in the 12 months before the claim. If you bought lifetime access, the limit is the price you paid for it.
12. Ending these terms
You can stop using SETL at any time by cancelling your subscription and deleting the app. These terms then end, except for the parts that by their nature should continue, such as sections 8, 11 and 14.
13. Changes to these terms
We may update these terms when SETL changes or the law changes. We will post the new version on this page with a new date. If a change is significant, we will also tell you in the app before it takes effect. If you do not agree to the new terms, you can cancel your subscription and stop using SETL.
14. Law and disputes
These terms are governed by the law of England and Wales. Any dispute will be handled by the courts of England and Wales. If you live in Scotland or Northern Ireland, you can also bring a claim in your local courts.
If you have a problem, please contact us first. We will try to put it right.
15. Other legal points
If a court decides that part of these terms is invalid, the rest still applies. If we do not enforce a right straight away, we can still enforce it later. You may not transfer your rights under these terms to anyone else. We may transfer ours to another business, for example if SETL is sold, and this will not reduce your rights.
